    I have just applied for the H1B visa and the USCIS made the explanation that it has already received over 150,000 applications making it over its 65,000 limit. When reading the official release, I have been puzzled with the following. what does it mean that they are exempt from any fiscal year cap ?

    "Cap-Exempt Petitions: As directed by the H-1B Visa Reform Act of 2004, the first 20,000 H-1B petitions filed on behalf of aliens with U.S.-earned masters’ or higher degrees are exempt from any fiscal year cap on available H-1B visas."

    I have a masters degree earned in USA so how does this helps me?

    there is a provision for additional 20000 H1B for people with US Masters degree on top of 65000. if you requested to be included in that cap then you might still have a chance. But the speculation is that that cap too will be filled considering the number of applications filed.
